SAVING'S FUND TERMS AND RESTRICTIONS
The Community Empower Home Saving's Fund (CEHSF) allows you to set aside current
funds to be used towards buying a house. The Stored Value Card you are using
has a Savings Account to keep your money until you find a house to buy. When
that time comes, you use your saved money, combine it with a loan that suits
you and purchase your house. The Community Empower Network has participants
that can help you find a home, help you through your credit management maze,
or help you get a loan.
SPECIAL FEATURE OF
HOME SAVING'S FUND
Additionally, if you buy a home from one of our Preferred Builders as arranged
through CEHSF, a Savings Certificate may possibly double the value of your
saved amount. To be eligible to use the Savings Certificate you must redeem it
exclusively through Community Empower's Home Saving's Fund as specified below.
Use of the Home Saving's Fund Savings Certificate requires that you be
registered with Community Empower Home Saving's Fund and have agreed to, all
the CE Network and the Stored Value Card Provider's terms and conditions.
SAVINGS CERTIFICATE
Value: The Savings Certificate's value may be equal to the amount of your
Home Saving's Fund Savings Account up to a maximum as specified by
the builder, subject to eligible loan programs and the specific Preferred
Builder's restrictions. The actual maximum will vary by the Preferred Builder
and home product. You will receive the value as a reduction of your cost of
the home.
Rules: The eligibility of you, the Buyer, for these programs is expressly
contingent upon:
1) your acceptance of the program's contractual terms and conditions;
2) the fulfillment of your obligations as specified in this document and the
related program documents;
3) the absolute fact that all the information and statements that you give us
or make are completely true and correct;
4) that you are intending to purchase and occupy a new home as your own
residence and not for use as a rental.
5) When you are ready for a Savings Certificate, you contact us and you must
give permission to your Stored Value Card provider to verify the amount and
status of your Savings Account in the Home Saving's Fund.
6) The Savings Certificate must be obtained by you before you make contact with
the Preferred Builder, it will only be valid for the Preferred Builder's
designated location for a specified length of time. The Savings Certificate may
expire or a new one may be reissued if the home purchase is not concluded
within the specified time frame.
7) At first contact with the Preferred Builder or his sales people, give him
the Savings Certificate and have him give you a receipt for it. The Savings
Certificate will identify you as a referred member of the Home Saving's Fund
Program and the Preferred Builder will know that your are entitled to the
benefits of the program. If you do not give the Preferred Builder your Savings
Certificate you will not be eligible to receive incentives or value from that
Preferred Builder.
8) No other real estate agent can be involved or due a commission from the
Preferred Builder.
9) The Sales Price in the real estate purchase contract must already include
the value of the Savings Certificate.
10) You must pay an amount equal to your Savings Certificate value from your
Home Saving's Fund Savings Account into your home purchase transaction.
11) Loss of eligibility will void the Savings Certificate.
12) If the purchase is not completed, for any reason, the Savings Certificate
has no cash value.
Not all
builder/Sellers are Home Saving's Fund Preferred Builders. If a particular
builder/Seller is not a Home Saving's Fund Preferred Builder, you may still use
the Home Saving's Fund to purchase a home but you will not be eligible to
receive the Savings Certificate value through the Home Saving's Fund. At this
time, Savings Certificates values are only available for home purchases in
Texas. However, the Home Saving's Fund can be used for home purchases in any
state where allowed by individual loan programs. Certain loan programs,
expressly FHA, VA and other government sponsored loan programs prohibit the use
of Savings Certificates. A CE Lending, LP mortgage professional may answer your
questions about eligible loan programs, regardless of the state. Other
restrictions may apply.
By registration in
this program, you accept all these program rules, terms and conditions. Also,
by acceptance of these program rules, terms and conditions you also give us
your express permission to share your contact information (your name, address,
telephone number) with our CE Networks participants, including third party
homebuilders or mortgage professionals, and you authorize them to contact you
just as if you directly requested services from them. Each CE Network
participant will ask you permission to use your personal financial information
for their own program.
One of the CE
Network participants is HYCA Development Services, LLC, (HDS), a licensed Texas
real estate broker. Our Preferred Builders, other builders, developers or
Seller's of real estate may pay HDS a real estate brokerage commission or
referral fee for your completed transaction or for other services as may be
requested by them. HYCA Development Services, LLC is an agent of the Preferred
Builder and/or the Seller and is not representing you as a Buyer. When you make
your home purchase from a builder/Seller that HDS has a relationship with or
redeem your Home Saving's Fund Savings Certificate with a Preferred Builder you
are agreeing with this compensation arrangement and acknowledge receipt of this
Specific Real Estate Disclosure below.
Notwithstanding
anything contained herein, you agree that COMMUNITY EMPOWER, HYCA LLC, HYCA
FINANCIAL SERVICES, LP, HYCA DEVELOPMENT SERVICES, LLC, HOMES YOU CAN AFFORD,
LP, CE LENDING, LP, AFFILIATES AND THE COMMUNITY EMPOWER NETWORK PARTICIPANTS
(COLLECTIVELY REFERRED TO BELOW AS THE PROGRAM PARTICIPANTS)will not be held
liable for any indirect, special or consequential damages of any kind, arising
from the use of this Home Saving's Fund or its related processes and any claims
or damages suffered by you, arising out of your use of PROGRAM PARTICIPANTS's
services is limited to the return of payments received by the PROGRAM
PARTICIPANTS from you.
AFFILIATED BUSINESS
ARRANGEMENT DISCLOSURE
Community Empower is a network name used by businesses with common ownership or
a compensable business relationship. Among others, the following businesses and
their roles are within the Community Empower network. CE Lending, LP, a
division of Prime Lending, a Plains Capital Bank and HYCA Development Services,
LLC, a licensed Texas real estate company are settlement service providers.
Homes You Can Afford, LP, and HYCA Financial Services, LP are in a position to
refer settlement services. Because of this common ownership or business
relationships, your use of the Community Empower network may result in
financial or other benefit for one or more of these companies. By using the
Community Empower network, you acknowledge receipt of this disclosure form and
understand that these companies may receive financial or other benefit as the
result of your use of the network
Real Estate
Disclosure: This is to give you notice that HYCA Development Services, LLC
(HDS), a licensed Texas real estate company, has business relationships with
affiliates of certain settlement service providers as well as entities that are
in a position to refer settlement services including builders and developers,
whereby such affiliates may provide real estate and non-real estate related
services. HDS has a contractual arrangement with your broker or seller to
provide certain real estate related and non-real estate related support
services in connection with your real estate transaction. This relationship may
provide HDS a financial or other benefit. Even though HDS may have contracted
with a third party to provide certain services in connection with your real
estate transaction, you will not be charged a duplicate fee for any such
services.
You may receive an
incentive from this broker or seller for using a preferred provider.

SERVICES AND THE BEST RATE FOR THESE SERVICES.
